1. INTERPRETATION & VARIATION

1.1 In these Terms and Conditions the following definitions apply: 
”Company” means Flowcore Pty Ltd, trading as Flowcore. 
”Client” means any person that attends a Flowcore Studio. “Studio” refers to the studio located at Level 1, 10 Pittwater Road, Manly, Sydney NSW 2095. A reference to a Studio in the Terms and Conditions will be to the studio at which a Client has booked to attend sessions. 
“Terms and Conditions” means these terms and conditions.
1.2 By booking a class / session at the Studio, the Client automatically agrees to these Terms and Conditions.
1.3 The Company reserves the right to vary and revoke the Terms and Conditions from time to time which variation it may consider necessary or desirable for the regulation of the affairs of the Studio and the conduct of Clients. Any such changes will be notified to Clients and, until revoked, are and will be binding on Clients.


2. CLIENTS


2.1 Subject to these Terms and Conditions, when a person has booked a class or a private session, regardless as to whether they are attending via a membership, a class pack, or a third-party booking system, they become a Client of Flowcore.
2.2 Acceptance of a person as a Client is at the absolute discretion of the Company.
2.3 The Company reserves the right to expel from the Studio, suspend for a specific period or refuse to renew the membership of any Client whose conduct is or may, in the Company’s reasonable opinion, be injurious to the character of the Studio or which amounts to a breach of the Terms and Conditions or where such expulsion is otherwise in the interests of the other Client of the Studio. Any Client so expelled will forthwith cease to be a Client of the Studio and will not be entitled to any refund for any period during which their membership is suspended.
2.4 Clients must be 18 or over to attend a Studio. Clients aged 14 -17 years, may attend with the Company’s prior permission, with a parent or guardian. Clients under the age of 14 are not permitted to partake in a class, but may attend a Studio, when accompanied by a parent or guardian. 

3. BOOKINGS, PAYMENTS, MEMBERSHIPS & CANCELLATIONS


3.1 A Client may not attend any session at the Studio without first booking and paying for the relevant session.

3.2 Details of session prices, membership prices, class pack prices and gift certificate prices are available at www.flowcorestudio.com.au.
3.3 All purchases are final. The Company does not offer refunds on services or products for change of mind, injury, illness or change of address. All purchases, payments and direct debit transactions are non-exchangeable, non-refundable or non-transferable. Unfortunately, we are not able to refund any client for unused Membership periods or Casual / Class Pack holders.
3.4 A Client may only book, cancel or reschedule sessions for themselves via their personal Flowcore account (at either www.flowcorestudio.com.au, the MindBody app, or a third-party booking platform such as ClassPass). We do not accept cancellations or reschedules via email or telephone
3.5 Sessions are booked on a first-come first-served basis. A Client may use the waiting list facility at www.flowcorestudio.com.au or via the MindBody app. If a Client joins the waiting list for a particular session and obtains a confirmed spot in that session, their booking will be subject to the Terms and Conditions in the usual way.
3.6 Class Packs currently available for sale expire on the following schedule: 

  • Intro Offer 4 x $40: 1 month after first visit

  • 1 x Class Pack: 3 months after sale date

  • 5 x Class Pack: 3 months after first visit

  • 10 x Class Pack: 6 months after first visit

  • 20 x Class Pack: 12 months after first visit

No extensions to the expiry date allocated to class packs will be allowed. 

3.7 Flowcore Memberships are valid from the date of purchase.
3.8 No Show Policy & Fees: If a Client books a class and subsequently does not attend, they have prevented another Client from attending. In such circumstances, Clients on Class Packs will forfeit payment for the session. Clients on a Flowcore Membership will be charged a $20.00 no show fee for failure to attend a booked class.There are no exceptions due to the small class size and popularity of these classes.
3.9 Cancellation Policy & Fees: Given that places in each session are limited and valuable to the Flowcore community, a strict 6-hour cancellation policy applies to all group class bookings. Class pack holders or who “late cancel” (less than 6 hours prior to a session) forfeit the payment, or class credit on their account, for that session. Flowcore Membership holders who late cancel will be charged a $10 late cancellation fee per incident. A 24-hour cancellation policy applies to all private sessions. Private sessions cancelled within 24 hours will forfeit payment for that session. There are no exceptions due to the small class size and popularity of these classes.


4. FITNESS & HEALTH


4.1 By agreeing to these Terms and Conditions, Clients hereby confirm that they have no health problems, including without limitation; cardiac irregularities; spinal, bone, joint, tendon or ligament injuries; spells of dizziness; asthma or other breathing difficulty; diabetes, epilepsy or any allergy, ailment or existing injury which may affect their participation in any sessions at the Studio.
4.2 It is the Client’s sole responsibility to notify the Studio before attending any session of any circumstances affecting their health which may be exacerbated through use of the Studio and/or which may have arisen or worsened since their last session at the Studio (if any).
4.3 Clients are advised not to undertake strenuous physical activity without first seeking medical advice if they have concerns over their physical condition and wellbeing. Clients with low/high blood pressure and/or cardiac irregularities should not attend class. If there is any doubt, the Client should consult his/her doctor.
4.4 The Company reserves the right to refuse access to any Client if, in its absolute discretion, it considers that the health of the Client concerned may be endangered by the use of Studio facilities.
4.5 Clients are required to follow the instructions of Flowcore instructors at all times.


5. LIMITATION OF LIABILITY


5.1 The Company cannot be held responsible for any particular session, instructor and/or item of equipment not being available for whatever reason. The Company reserves the right to make alterations to the sessions, instructors and/or equipment, provided to Clients, without notice and at its absolute discretion. The Company will not be liable for any loss occasioned by such alterations except insofar as such loss is by law incapable of exclusion.
5.2 It is the Client’s responsibility to ensure that they are capable of undergoing a routine of exercises provided by any programme which they follow, or class which they attend. Clients accept the risk of injury from performing exercises and using specialist equipment and are advised to consult their doctor prior to beginning any session. Advice provided by Flowcore instructors at no time constitutes medical advice.

5.3 The Company is not responsible for the safekeeping of your belongings.

5.4 The Company is not liable to refund, transfer or offer compensation of any kind for sessions that are late, changed or cancelled for any reason, or if you are unable to attend a class because it is full.

5.5 By voluntarily attending classes at Flowcore, you confirm your understanding that classes at Flowcore may be physically strenuous, and you voluntarily participate in them with full knowledge that there is a risk of personal injury, property damage or death. You also agree that neither you, your heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against the Company, or its directors, officers, employees, agents, consultants or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise. By agreeing to these Terms and Conditions, all Clients, in consideration of their participation in Flowcore sessions, hereby release the Company and their agents from any claims, demands, and causes of action as a result of their voluntary participation and enrollment in said sessions.


6. SAFETY & HYGIENE


6.1 In the interests of safety and hygiene, no crockery, glass or food are permitted in the changing rooms or studio. Only water is permitted in the Studio. No pets are permitted in the Studio.
6.2 Clients must not attend a Studio if they have any form of contagious disease or infection.
6.3 Clients must use the main entrance to the Studio when entering or leaving the Studio. Fire exits, which are clearly marked, are there in the interests of safety and Clients must not interfere with these exits for any reason. In the event of a fire, Clients should  make their way to the nearest available exit.
6.4 Smoking and vaping is forbidden in the Studio.

7. GENERAL TERMS OF SERVICE

7.1 The Company reserves the right to cancel and change teachers, events, classes, workshops and teacher training without prior notice. 

7.2 If a class is full, or if the teacher considers the class to be full, they may refuse entry.

7.3 First time Clients must arrive 15 minutes before the start of their booked class. All Clients must be checked-in 5 minutes before the class start time. Seats may be given up to wait-listed Clients within 5 minutes of the class start time. Late arrivals will not be admitted into class. 

7.4 All Class Packs and Memberships are non-transferable and may not be shared

7.5 The introductory offer, or (‘Intro Offer’) may only be purchased by new visitors who have not yet attended the Studio. These offers can be used once only and are valid for one month after your first attended Session. No refunds, transfers, suspensions or extensions are offered on unused classes.

7.6 The Company may, if a Client opts in, communicate with the Client by electronic mail (“email”) and text message. By providing an email address and/or phone number to the Company the Client consents to receiving communications from the Company, including notices pursuant to the Terms and Conditions. 

7.7 Clients are required to give email notice to the Company of any change of email address or phone number. Failing such notice, all communications will be assumed to have been received by the Client within five days.

7.8 The Company reserves the right to refuse admission to the Studio.

7.9 Clients must at all times comply with any reasonable directions which the Company may issue to ensure the smooth operation of the Studio.

7.10 Any marketing, educational or other materials of any nature whatsoever produced by the Company in connection with the Studio and which are made available to Clients at the Studio will at all times remain the property of the Company and will be subject to the Company’s copyright.


7.11 There may be further and more specific terms and conditions that relate to our Offers, Class Packs and Membership options. By purchasing any of these Class Packs or Memberships, or attending any session using one of these Class Packs or Memberships, you acknowledge and agree that you have read, understood and agreed with those further terms.
